I'll submit that this qualifies the difference between arson
and DoS as one of degree, not of kind.  Both are attacks.
Both represent an individual performing unjustified and 
in most cases illegal actions against another.

It's still an assault whether I slap another on the face with a 
lady's glove or stick a long knife in his back.  The two differ
greatly in degree, and in the amount of force justified in
preventing them.
