Strictly speaking you are correct.  the law has been dancing on a head of a
pin on this issue for a while.

I think that when/if the DeCSS case tosses out the DMCA as
unconstitutional, all the
rest of this is going with it.

Also, I can think of a number of laws which are unconstitutional, even
deemed so in court, and continue to be enforced.
